Court musings 9-15-17

Had an opportunity to participate in a day of service at the courthouse yesterday and it filled me with optimism and the realization that it is an imperative for Criminal Defense Attorneys to work to provide access and fight for the oppressed people in our society.

We continue to suffer with police making arrests and stops for illegitimate and racially biased reasons. We continue to suffer in a system that is cold and heartless.

All of the actors in the Criminal Justice ...

This week in court 9/26/16

The week is not over yet, but it has already been a rollercoaster.

More protests, more marching, more arrests of peaceful protestors.

I am working alongside several other wonderful lawyers to provide legal assistance to many of the arrested protestors.  Most of the people I have met are educated and do not have a criminal record.  They are decent people who were arrested for invoking their constitutional rights to speak out against injustice.  This will be a long struggle and this cases ...

This week in court 9/19/16

What a week.  I dont think Charlotte has seen anything like this week in quite sometime.

I came home from an Dismantling Racism workshop Tuesday evening to learn that there had been ANOTHER CMPD Officer involved shooting and death earlier in the day.  To no surprise, the victim was a Black Male.  I turned on the TV to see pictures of a small protest going on in the University area.  I watched the sights and sounds for most of the night.

This week in Court 9/12/16

We had a GREAT week in court!

After a 3 day Jury Trial, it only took the Jury 20 minutes to find my client NOT GUILTY of the Felony crime he was accused of.

Jury Trial’s are the most intense courtroom experience we Criminal Defense Attorney’s have.  It is so fulfilling to try a case well and get that idea result for a truly deserving client.

It was also nice to try a case against a prosecutor who fights hard but fair.  We ...

This Week in Court 9/6/16

I was happy to watch a good friend win a trial in a very serious matter. The State had a garbage case that rested solely on one cross-racial ID. The victim initially insisted that the person who assaulted her had a neck tattoo. However, she ID’ed someone without a neck tattoo. It seemed like a case of “any old hispanic man will do.” Thankfully, the Judge saw through it and found the man without a neck tattoo NOT GUILTY!

This Week in Court 8/29/16

We argued a very good suppression motion related to the execution of a search warrant in a Firearm By Felon case. Had one of the most respected Superior Court Judges hear it. He is taking it under advisement, which means he will rule on motion in the near future.

I saw the State prosecute a man for a bit of heroin that was in another man’s sock. The “war” on Drugs is tired, broken, and needs to be replaced with a ...
